Extended Warranty+ Terms & Conditions

1. Introduction and Acceptance
These Extended Warranty+ Terms & Conditions (“EW+ Terms”) govern Extended Warranty+, an optional, separately priced limited service plan (“Extended Warranty+” or the “Plan”) offered for certain Canary Equipment. These EW+ Terms are an agreement between you and Arlo Technologies, Inc. (“Arlo”), represented by Canary Connect, Inc. As used in these EW+ Terms, “Canary,” “we,” “us,” and “our” mean Canary Connect, Inc., operating on behalf of Arlo. Extended Warranty+ is offered only in the United States, and only in the states listed in Section 3.
Extended Warranty+ is sold and administered in-house. It is offered in addition to, and is governed separately from, the standard Limited Warranty and the Extended Warranty included with certain Premium Services plans. By purchasing Extended Warranty+, you agree to these EW+ Terms, to the Canary Sales Terms, and to the Canary System Terms & Conditions, each available at canary.is/legal and incorporated into these EW+ Terms by reference. In the event of a conflict between these EW+ Terms and the Sales Terms or the System Terms with respect to the subject matter of Extended Warranty+, these EW+ Terms control.
Extended Warranty+ is a service plan; it is not a contract of insurance, and Canary and Arlo are not insurers. You should maintain your own property and other insurance sufficient to cover any loss, damage, or expense relating to your Equipment.
2. Definitions
- “Breakdown” means the mechanical or electrical failure of an Eligible Device to operate, resulting from a defect in materials or workmanship or from normal wear, occurring during normal use in accordance with Canary’s technical specifications and user manual, and arising after the Coverage Start Date. Breakdown does not include any condition excluded under Section 6.
- “Coverage Start Date” means the date that is thirty (30) days after the date you purchase Extended Warranty+ for an Eligible Device (see Section 4).
- “Coverage Year” means each twelve (12) month period beginning on the Coverage Start Date and on each annual anniversary of the Coverage Start Date during which the Plan remains active and paid.
- “Covered Device” means an Eligible Device for which you have purchased, and continue to maintain, an active and paid Extended Warranty+ Plan, and for which the Coverage Start Date has occurred. Extended Warranty+ is purchased separately for each device, so only the specific device or devices you enroll are Covered Devices.
- “Eligible Device” means a Canary Pro or Canary View camera that is registered to your Canary account and that was activated, online, and in good working order at the time Extended Warranty+ was purchased for that device.
- “Eligible State” means a U.S. state listed in Section 3 in which Canary makes Extended Warranty+ available.
- “Limited Warranty” means the Canary One (1) Year Limited Warranty set out in Canary’s Returns, Refunds & Limited Warranty, available at canary.is/legal.
- “Extended Warranty” means the warranty extension included with certain Premium Services plans, as described in the Sales Terms and the Limited Warranty. The Extended Warranty is not Extended Warranty+.
- “Replacement Device” means a Canary device of the same or a similar model, which may be new or recertified, that Canary provides under the Plan or under the Theft Replacement Courtesy Program.
3. Eligibility and State Availability
Extended Warranty+ is available for purchase only by residents of, and at addresses located in, the following U.S. states (“Eligible States”):
Alaska, Connecticut, Delaware, Georgia, Idaho, Indiana, Iowa, Kansas, Kentucky, Louisiana, Michigan, Mississippi, Nebraska, North Dakota, Pennsylvania, Rhode Island, South Dakota, Tennessee, Utah, Vermont, and West Virginia.
Extended Warranty+ is not available in any other U.S. state or in the District of Columbia, and is not available outside the United States. Orders placed from a state that is not an Eligible State, from the District of Columbia, or from outside the United States will not be accepted. Canary may add or remove states from the list of Eligible States at any time on prospective notice; if Canary removes your state, any Extended Warranty+ Plan you have already purchased will remain governed by these EW+ Terms for the remainder of the then-current, paid Coverage Year.
Extended Warranty+ is available only for the Canary Pro and the Canary View. To purchase Extended Warranty+ for a device, the device must be registered to your Canary account and must be activated, online, and in good working order at the time of purchase. Extended Warranty+ is purchased and billed separately for each device.
4. Term, Waiting Period, and Coverage Start Date
Extended Warranty+ is an annual plan. There is a waiting period of thirty (30) days from the date you purchase Extended Warranty+ for an Eligible Device. Coverage begins on the Coverage Start Date, which is the day after the thirty (30) day waiting period ends. No Breakdown that occurs, and no theft that takes place, before the Coverage Start Date is covered or eligible for any benefit under the Plan or under the Theft Replacement Courtesy Program. The waiting period does not shorten or affect your cancellation and refund rights under Section 12.
The Plan renews automatically for successive annual terms at the then-current price unless cancelled in accordance with Section 12 and the Sales Terms. Each renewal begins a new Coverage Year.
5. What Is Covered — Breakdown Protection
If a Covered Device suffers a Breakdown during a Coverage Year while the Plan is active and paid, Canary will, at its option, repair the Covered Device, replace it with a Replacement Device, or, where neither is reasonably practicable, refund the price you paid for the Covered Device, in each case subject to these EW+ Terms. There is no deductible for a Breakdown claim, and you are limited to one (1) replacement per Covered Device per Coverage Year, which covers Breakdown Protection and the Theft Replacement Courtesy Program combined. A Covered Device is eligible for only one (1) replacement in a Coverage Year, whether that replacement is provided for a Breakdown or as a Theft Replacement courtesy. Once Canary has provided a repair, Replacement Device, or refund for a Covered Device in a Coverage Year (whether for a Breakdown or as a Theft Replacement courtesy), Canary’s obligation to provide any further replacement for that Covered Device for that Coverage Year is fully satisfied.
Extended Warranty+ continues to provide Breakdown Protection for as long as the Plan remains active, paid, and available for the Covered Device, without a fixed end date. This ongoing protection refers to the duration of coverage and not to the number of claims; the limit of one (1) replacement per Covered Device per Coverage Year applies.
6. What Is Not Covered
Extended Warranty+ does not cover, and no benefit (including the Theft Replacement Courtesy Program) is available for, any of the following:
- any condition, failure, defect, damage, or theft arising or occurring before the Coverage Start Date, or any pre-existing condition;
- loss, misplacement, or mysterious disappearance of a device (which is distinct from theft; see Section 7);
- theft that is not evidenced by a police report meeting the requirements of Section 7, or theft of a device that was not a Covered Device at the time of the theft;
- damage caused by misuse, abuse, accident, neglect, unusual stress, liquid or fire damage, alteration, modification, or improper or unauthorized installation, repair, testing, or storage, or use of the device outside the permitted or intended uses described by Canary;
- cosmetic damage that does not affect the device’s function;
- consumable parts, such as batteries, unless the failure resulted from a defect in materials or workmanship;
- any software, and any device that is not a Covered Device;
- accessories, and any device or accessory purchased from anyone other than Canary or an authorized reseller;
- damage or loss covered by the Limited Warranty, the Extended Warranty, any other warranty, or any insurance;
- commercial use, and any use other than ordinary personal, residential use; and
- any device acquired through, or any claim involving, fraud, misrepresentation, or unauthorized resale.
7. Theft Replacement Courtesy Program
The following describes the Theft Replacement Courtesy Program (the “Program”). It is not part of the contractual coverage under Extended Warranty+. It is not insurance, it is not a warranty, and it is not a service contract. Canary has no obligation to provide a replacement under the Program, will determine in its sole discretion whether any claim qualifies, and may modify, suspend, or terminate the Program at any time without notice.
The Theft Replacement Courtesy Program is a complimentary courtesy program provided to customers with an active Extended Warranty+ Plan in an Eligible State. If a Covered Device is stolen, Canary may, as a courtesy and in its sole discretion, provide a replacement with the same or a similar model (new or recertified), if: (i) a police report identifying the stolen device is filed within thirty (30) days of the theft; (ii) a claim is submitted to Canary within thirty (30) days of the police report, with a copy of the police report and proof of purchase of the device from Canary or an authorized reseller; and (iii) at the time of the theft, the stolen device was a Covered Device registered to your Canary account (Extended Warranty+ must have been purchased for that specific device; theft of a device on your account that is not a Covered Device is not eligible). The Program is non-transferable and excludes accessories, purchases from unauthorized resellers, and theft of packages in transit. Loss, misplacement, and mysterious disappearance of a device are not eligible. A Theft Replacement counts toward the single replacement available for a Covered Device per Coverage Year; if a replacement has already been provided for that Covered Device in the Coverage Year (whether for a Breakdown or as a Theft Replacement courtesy), no further replacement is available for that Covered Device for the remainder of that Coverage Year. Canary’s claim decisions are final, and Canary may decline a claim for its reasonable business concerns, including suspected fraud or repeated claims.
The Theft Replacement Courtesy Program is offered only to customers with an active Extended Warranty+ Plan in an Eligible State; it is not available in any state that is not an Eligible State.
8. How to File a Claim
To file a claim, log in to your account at my.canary.is and go to your Account page. For a Breakdown claim, Canary may require you to complete troubleshooting steps and to provide photographs or video of the device, the device’s serial number, proof of purchase, and proof that the device is a Covered Device. For a Theft Replacement courtesy claim, Canary requires a copy of the police report identifying the stolen device and proof of purchase, submitted within the windows described in Section 7. Canary may require you to verify eligibility before any repair, Replacement Device, or courtesy replacement is authorized, and may deny or investigate any claim that it reasonably suspects involves fraud or misuse.
9. Replacement Devices; Ownership; Return of Original Device
A Replacement Device may be new or recertified and of the same or a similar model and like function. A Replacement Device assumes the remaining term of the Plan for the Covered Device it replaces. Consistent with the Sales Terms, where a device is provided to you as part of the Products or the Plan, it remains our property to the same extent as the device it replaces, and title does not transfer to you except as expressly stated in writing.
For a Breakdown claim, unless otherwise instructed, you must return the original device for which a repair, Replacement Device, or refund is provided, in accordance with Canary’s return instructions (including any Return Material Authorization), within fourteen (14) days. If you do not return the original device within that period, Canary may charge a non-return fee up to the value of the Replacement Device or the unreturned device, and/or pursue the other remedies described in the Sales Terms. A device reported stolen under the Theft Replacement Courtesy Program need not be returned.
10. Limitation of Liability
Canary’s and Arlo’s entire obligation and liability under Extended Warranty+ for any Covered Device in any Coverage Year is limited to providing the repair, Replacement Device, or refund expressly described in these EW+ Terms for that Covered Device for that Coverage Year and, under the Theft Replacement Courtesy Program, to the discretionary courtesy replacement (if any) described in Section 7. Except for that obligation, the limitations of liability and the disclaimers in the Sales Terms and in the System Terms (including Section 17 of the System Terms) apply to Extended Warranty+ and to your use of any Covered Device or Replacement Device, and neither Canary nor Arlo is liable for any indirect, incidental, special, punitive, or consequential damages. Nothing in these EW+ Terms excludes or limits any liability that cannot be excluded or limited under applicable law.
11. Pricing, Billing, and Auto-Renewal
Extended Warranty+ is sold on a per-device basis at the price posted at the time of purchase. Extended Warranty+ is billed annually and renews automatically on each annual anniversary at the then-current price, in accordance with the Sales Terms, unless you cancel or opt out of automatic renewal. Applicable taxes may apply. Billing, payment, automatic renewal, and related terms are governed by the Sales Terms.
12. Cancellation and Refunds
Extended Warranty+ is an annual Additional Service. Consistent with the Sales Terms, you may cancel Extended Warranty+ for a full refund only within fourteen (14) days of initial registration of the Plan for a device (excluding renewals). Any cancellation after the first fourteen (14) days will be effective at the end of the then-current annual term, and no credits or refunds will be issued. The thirty (30) day waiting period does not shorten this fourteen (14) day refund window. You may cancel, or opt out of automatic renewal, at my.canary.is or as described in the Sales Terms.
13. Not Insurance; No Coverage of Loss
Extended Warranty+ is a service plan offered by the manufacturer of the Canary Pro and Canary View Equipment and is not insurance. Canary and Arlo are not insurers, and the fees for Extended Warranty+ are based solely on the services provided and on the limitations of liability and other risk-allocation terms in these EW+ Terms, the Sales Terms, and the System Terms. The Theft Replacement Courtesy Program is a discretionary courtesy and is not insurance, a warranty, or a service contract. You should maintain your own property and other insurance sufficient to cover any loss, damage, or expense relating to your Equipment.
14. Transfer
Extended Warranty+ and the Theft Replacement Courtesy Program are personal to you and are non-transferable by assignment, sale, or otherwise, consistent with the treatment of Additional Services in the Sales Terms. If you transfer an Eligible Device to another person, Extended Warranty+ does not transfer with it.
15. Dispute Resolution; Governing Law; Changes; Contact
The dispute resolution, binding arbitration, class action waiver, and jury waiver provisions in Section 19 (“Disputes”) of the Canary System Terms & Conditions, and the Governing Law & Venue provisions in Section 20 of the System Terms, are incorporated into these EW+ Terms by reference and apply to any dispute relating to Extended Warranty+ or the Theft Replacement Courtesy Program, with respect to both Canary and Arlo. These EW+ Terms are governed by the law of the State of Delaware, without regard to conflicts of law principles, and, except for disputes subject to arbitration, any disputes will be heard in the state or federal courts located in New York County, New York.
